  1. Purpose of this Privacy Statement

Protecting and respecting your Personal Information is important to us.

This Privacy Statement explains how Finance Warehouse (Pty) Ltd collects, uses, stores, shares and protects your Personal Information in line with the Protection of Personal Information Act, 4 of 2013 (“POPIA”).

By engaging with our services, submitting an enquiry, completing an application form, or communicating with us, you acknowledge that your Personal Information may be processed in accordance with this Privacy Statement.

  1. Protection and confidentiality of Personal Information

We accept a shared responsibility with you to ensure that your Personal Information is processed lawfully and responsibly.

We will:

  • only process your Personal Information for legitimate business purposes;
  • keep your information confidential and secure;
  • take reasonable steps to prevent unauthorised access, loss, misuse, or disclosure; and
  • ensure your information is used for the purpose it was collected for.
  1. Acting for service and product providers

Finance Warehouse collects and processes Personal Information to provide you with the services we offer, including asset finance facilitation and where applicable, value-added products and services offered by service providers with whom we have agreements in place.

  1. The purpose for the information we collect

The Personal Information we collect is required for the facilitation of asset finance and related services. We will inform you of what information is required and why it is needed.

Your Personal Information may be shared with:

  • credit providers (banks / finance houses) for the purpose of assessing and facilitating credit; and
  • service providers (where you choose value-added products or services), who may require additional information to deliver their services.

All third parties we share information with are required to comply with POPIA and to process your information securely and lawfully.

To ensure accuracy and correctness, we will generally collect Personal Information directly from you, and we will take reasonable steps to ensure it remains accurate and up to date.

  1. Use of your Personal Information

Finance Warehouse will use your Personal Information only for the purpose for which it was collected and agreed to by you, including (but not limited to):

  • processing and facilitating finance applications;
  • offering and administering value-added products and services (where applicable);
  • verifying your identity and related information as required by legislation;
  • detecting and preventing fraud, crime, money laundering and other unlawful activities;
  • providing services and support requested by you;
  • communicating with you regarding your application, enquiry, or services;
  • complying with legal, regulatory, and contractual requirements.
  1. Disclosure of Personal Information

If you elect to take up a value-added product or service, we may share your Personal Information with the relevant provider(s) to enable them to deliver that product or service.

We will only disclose your Personal Information to third parties where:

  • you have provided consent (where required);
  • we have a legal or contractual duty to do so;
  • disclosure is permitted or required under applicable law; or
  • it is necessary to protect our legitimate interests, including preventing fraud or enforcing agreements.
  1. Sharing your information outside South Africa

Finance Warehouse will not share your Personal Information outside the borders of South Africa unless:

  • you request us to do so; and/or
  • it is necessary to provide a service you have requested.

Where cross-border processing is required, we will request your written consent where applicable and ensure reasonable safeguards are in place.

  1. Security of your Personal Information

POPIA requires us to secure your Personal Information. Finance Warehouse takes reasonable technical and organisational measures to protect Personal Information against loss, damage, unauthorised destruction, unlawful access or processing.

We continuously review our internal processes, systems and safeguards to maintain the confidentiality and integrity of Personal Information.

If we transfer Personal Information to another organisation for processing or storage, we will take reasonable steps to ensure that the recipient maintains the same level of protection required under POPIA.

  1. Access, correction and deletion of Personal Information

You have the right to request access to the Personal Information we hold about you. Before providing any Personal Information, we will verify your identity.

You may request that we:

  • update or correct your Personal Information; and/or
  • delete Personal Information where appropriate.

Please note that we may be required to retain certain information for legal and regulatory purposes for a specific period of time.

  1. Retention of information

Finance Warehouse may retain Personal Information for as long as necessary to fulfil the purpose for which it was collected and to comply with applicable legal and regulatory requirements.

Relevant legislation may include (but is not limited to):

  • the Financial Advisory and Intermediary Services Act, 2002 (FAIS); and
  • the Protection of Personal Information Act, 2013 (POPIA).

If you believe that Finance Warehouse has processed your Personal Information in a manner that is inconsistent with POPIA, we encourage you to contact us first so that we can address your concerns.
